: The minimum of marriageable age becomes an interesting topic in Indonesia. As the most populous Muslim country, Indonesia should exert the Islamic teaching in the case. Aisha, the Prophet Muhammad's wife, get married to the Prophet when she was six and consummate to him when she was nine. The Indonesian government, as a member of the United Nations (UN), should follow and ratify the UN treaties that prohibited the child marriage. This study employs conceptual and statute approach to examine the problem of marriageable age based on maqasid al-shariah and psychological perspectives. The results of this study are: (1) Islamic law does not decide the minimum age to get married to the bride and the groom. The Quran conditions for the bride and the groom to have, at least, a rushd quality to get married. (2) Based on the maqasid al-shariah and psychological perspectives, the minimum of marriageable age, 16 years and 19 years for the bride and the groom respectively should be preserved but the bride who got married in 16 years was still the child who should be under the protection of her parents.
The minimum age for marriage in fiqh has been a debated issue. This minimum limit is typically interpreted with reference to Aisha's marriage to the Prophet. Husein Muhammad argued, contrary to popular belief that Aisha's age at the time of her marriage was eighteen, not nine. This paper explains the characteristics of Husein's views on the minimum age for marriage in Islam. The data was collected from reviews of Husein's and other researchers' works in which they discussed Husein's ideas. This paper argues that, according to Husein, it is demonstrably untrue to postulate that Aisha was nine years old when she married. Husein concluded that Aisha was at least eighteen when she wed the Prophet. This interpretation arises as a result of his comparison between Aisha's age and Asma's. Besides that, Husein also considers the maqāṣid syarīah principle, according to which the age of eighteen is the minimum age that is physically and psychologically ideal and more compatible with the soul preservation of women and their future offspring.[Batas usia minimum perkawinan dalam fikih tidak ditetapkan secara pasti. Muhammad's conjugal life can defined into two periods: pre-hijra in Mecca (570–622), and post-hijra in Medina (622–632). At the age of 25, Muhammad married the wealthy Khadija, who was 40 years old. The marriage lasted for 25 years and was a happy one. Muhammad did not enter into marriage with another woman during this marriage. After Khadija's death, Khawla bint Hakim suggested to Muhammad that he should marry Sawdah bint Zam'ah, a Muslim widow, or Aisha, daughter of Umm Ruman and Abu Bakr of Mecca. Muhammad is said to have asked for arrangements to marry both. According to classical sources, Muhammad married Aisha when she was 6–7 years old; the marriage was consummated later, when she was 9 years old and he was 53 years old.
Muhammad performed household chores such as preparing food, sewing clothes, and repairing shoes. He is also said to have accustomed his wives to dialogue; he listened to their advice, and the wives debated and even argued with him.
Khadija is said to have had four daughters with Muhammad (Ruqayya bint Muhammad, Umm Kulthum bint Muhammad, Zainab bint Muhammad, Fatimah Zahra) and two sons (Qasim ibn Muhammad and Abd Allah ibn Muhammad, who both died in childhood). All but one of his daughters, Fatimah, died before him. Some Shia scholars contend that Fatimah was Muhammad's only daughter. Maria al-Qibtiyya bore him a son named Ibrahim ibn Muhammad, who died at two years old.
Nine of Muhammad's wives survived after him. Aisha, who became known as Muhammad's favorite wife in Sunni tradition, survived him by decades and was instrumental in helping assemble the scattered sayings of Muhammad that form the hadith literature for the Sunni branch of Islam.
Zayd ibn Haritha was a slave that Khadija gave to Muhammad. He was bought by her nephew Hakim ibn Hizam at the market in Ukaz.
